2257 Compliance Guide for Adult Content Creators (2026)

18 U.S.C. 2257 requires adult content producers to keep age verification records for every performer. Here's exactly what you need and how to stay compliant.

What Is 18 U.S.C. 2257?

18 U.S.C. 2257 is a United States federal law that requires producers of sexually explicit content to:

1. Verify that every performer appearing in sexual content is at least 18 years old

2. Maintain those age verification records for a minimum of 7 years

3. Make those records available for inspection by the Attorney General's office

The law applies to primary producers (the person who actually filmed the content) and secondary producers (platforms that host the content).

The penalties for non-compliance are severe — up to 5 years in prison for a first offense. This is not a law to take lightly.

Who Is a "Producer" Under 2257?

If you filmed the content yourself, you are a primary producer.

If you are a platform that hosts content you did not film, you are a secondary producer — still required to maintain records, but with slightly different obligations.

If you appear in content someone else filmed, the person who filmed it is the primary producer and is responsible for maintaining your records. However, you should always ensure you have your own copy.

What Records Must You Keep?

For every performer appearing in sexually explicit content, you must maintain:

Required documents:

  • Government-issued photo ID (driver's license, passport, or similar)
  • The ID must show the performer's legal name and date of birth
  • Verification that the date of birth confirms they are 18 or older

Recommended documents (not legally required but strongly advisable):

  • A signed model release / consent agreement
  • A "selfie with ID" photo (performer holding their ID)
  • Secondary ID if available
  • Contact information

For each piece of content, you must also record:

  • The date the content was produced
  • The name and address of the primary producer
  • The stage names used by each performer

What Happens During an Audit?

Under 2257, the U.S. Attorney General has the authority to inspect records. In practice, inspections are extremely rare and typically only occur after complaints.

What inspectors look for:

  • A complete record for every performer in every piece of content
  • Records kept for at least 7 years
  • Records accessible at a designated "custodian of records" address

For most independent creators, keeping organized digital records in a secure location (cloud storage, encrypted drive) is sufficient.

Special Cases

International performers: 2257 applies to content "produced in the United States or intended for distribution in the United States." Foreign passports are acceptable as the government-issued ID.

If you appear solo in your own content: You must still keep records for yourself, including a copy of your own ID. This seems odd but is legally required.

Older content: If you have existing content that was produced before you had a proper records system, you should make reasonable effort to obtain and file records retroactively. Document the effort if you cannot locate the performer.

Custom content for specific buyers: Same requirements apply. Date, performer verification, and a copy of their ID must be on file before you film.
